Questioning is a powerful alternative to making statements.

A good question is often much better than a defensive remark, or a counter-accusation, for all sorts of situations. Using an open question (What. How. especially) is a simple and effective technique for resisting forceful or bullying pressure. Using questions, rather than statements and guesses, is also very effective for building trust, diffusing conflict, understanding situations, managing other people, teaching, training, and parenting. Traditionally, questioning is regarded as mainly a selling skill, but it’s powerful and productive in virtually every circumstance involving human cooperation.

Is Lemon Water a Legit Wellness Trend?

Here are some benefits of using lemon in your water.

Lemon water is a two-ingredient drink hailed as one of the most popular magic potions in the wellness community, touted as the key to healthy digestion and healthy skin.

“If you look at any Instagram feed of a wellness guru, they’re going to proselytize, ‘Drink lemon water in the morning. It’s good for you,’” said Michele Promaulayko, editor-in-chief of Yahoo Health.

The idea is that after you wake up, you squeeze some lemon into a glass of warm water and drink it. The combination is said to help promote digestion, alkalize the body and boost your immunity.

As part of the “GMA” Yahoo Your Day series, “GMA” met up with Promaulayko to see if lemon water is a legit wellness trend, or one you should quit.

“There are some health benefits and one of them is aiding in digestion,” Promaulayko said. “It actually slows the absorption of food, which sounds counterintuitive to helping digestion, but what it does is give your body time to break down that food and take the nutrients that it needs from it.”

Promaulayko says another benefit of lemon water is that anyone can do it.

“It doesn’t matter if you’re Paleo or Gluten-free, you can do lemon water,” she said.

With all its benefits, Promaulayko calls lemon water a legit wellness trend.

“It’s absolutely legit,” she said. “Drinking lemon water aids in digestion [and] it boosts your Vitamin C level.”

“The Vitamin C is great for your skin,” Promaulayko added. “It’s immunity boosting so you’re getting double the profit and it helps your body break down so you can derive more nutrients out of it.”

Promaulayko describes any potential downsides of lemon water as “pretty benign” but says there is one drawback that users should pay attention to.

“The acid from the lemon juice can erode the enamel on your teeth,” she said. “So you want to be careful with that.”

When to File a Medical Malpractice Lawsuit

Filing a medical malpractice suit against a doctor, nurse or hospital for negligence resulting in injury is a difficult endeavor at best. Medical negligence lawsuits are some of the most complex and difficult cases to prosecute, due to the very specific requirements regarding standard of care. as well as the large costs associated with investigating a medical malpractice claim.

If you have been injured due to the negligence of a physician, dentist, nurse, surgeon, anesthesiologist, or other medical professional. then you may have the right to pursue legal action and demand compensation for your injury. Before you do, ask yourself the following questions:

Were You Injured?

In order to bring a medical malpractice lawsuit, there must be damages for which to seek monetary compensation. Let’s suppose a doctor failed to diagnose coronary artery disease when a patient came to the emergency room complaining of chest pains. The patient then goes to another hospital where a doctor correctly recognizes an impending heart attack and treats the man accordingly.

Had the man not gone to the next hospital, he may have died, and the failure to diagnose may indeed be medical negligence. However, “the doctor could have killed me” is not enough for the US court system. In order to bring a malpractice suit, there must be an injury or damages of some sort.

Is Your Injury Serious Enough to Merit Filing a Suit?

It seems logical that anyone injured by the negligence of a doctor should have the right to file a claim for damages. They do, but there is one problem – Medical malpractice lawsuits are expensive. Filing and pursuing a claim for medical malpractice requires a large down payment for the investigation, professional medical consultation and evidence, preparation of the case and more. In order for the claim to be worthwhile, the damages have to be greater than the cost of prosecuting the suit.

An attorney may believe that you have a great case, but if the injury is minor, say something that required only a week of recovery, then the lawsuit would probably cost more to prosecute than the award or settlement would be. A medical malpractice lawyer can not afford to take on these cases because they already take a great financial risk with other, larger lawsuits due to the fact that they are the ones paying for everything. They don’t receive any payment until they win their clients case.

Did Your Doctor Perform with a Reasonable Level of Care?

This is one of the most difficult questions to answer, and usually requires an experienced medical malpractice lawyer. Even an experienced lawyer will have to seek an opinion from a medical doctor, which is why most medical malpractice attorney have a medical professional on staff or nearby. Proving a doctors negligence in a medical malpractice case is critical for a successful settlement or jury award.

Some of the most common forms of medical negligence include the following:

Misdiagnosis or Delayed Diagnosis

If a doctor fails to diagnose an illness, injury or disease, or doesn’t diagnose it soon enough to allow for proper treatment, it may qualify as medical negligence. In order to establish the negligence, another doctor will need to evaluate the circumstances of the case and determine whether the doctor should have diagnosed the medical problem correctly.

Wrong Site Surgery

In a case of wrong site surgery. a doctor may be held liable for operating, or in some severe cases, amputating the wrong body part. There have been instances where someone needs to get a leg amputated, but the medical staff amputates the wrong leg, leaving the patient with both legs gone.

Surgical Errors

During surgery, the doctor is required to operate with such care so as to not cause any injury inside the patients body. Sometimes, a careless doctor may burn or cut an organ or other internal part causing severe injury to the patient. (Click this article to read about Three Real Life Case Studies of Surgicial Mistakes .)

Failure to Follow Up with Treatment

Should a particular treatment be ordered to help cure a patient of an illness, the doctor is required to follow up regularly and monitor progress to ensure that the treatment is working, and doesn’t go on unnecessarily long.

Birth Injuries

It is possible for a doctor to mishandle a baby during child birth. causing potentially permanent damage to the newborn. Alternatively, a doctor may not act accordingly to signs of fetal distress during a difficult birth, which can also lead to injury of the child or mother.

There are many more types of negligence, but the key point to note is that, when determining a doctors negligence, it must be determined that he or she could have prevented the injury had they taken more care, or more specifically, performed to the “accepted medical standard of care”.

Get Legal Advice from a Medical Malpractice Lawyer

If you believe that you may have suffered an injury due to the negligence of a doctor or other medical professional, then you should think about talking to a medical malpractice attorney. Most of these specialized lawyers will offer a free consultation where you can explain the circumstances of your case and get qualified legal advice regarding your options for getting monetary compensation through a civil lawsuit.

Get the compensation you deserve.

Filing an Auto Accident Complaint

Every day, people are hurt and killed in auto accidents in the United States. Accidents happen for all different reasons. However, whether you are hurt in a hit and run accident, a parking lot accident or one of the many kinds of truck accidents, you typically need to complete certain auto accident forms and to file an auto accident complaint in order to recover damages.

How to File an Auto Accident Complaint

After you have completed your accident investigation and all of your auto accident forms, it will be time to file an auto accident complaint to seek financial recovery for the property damage and personal injuries that you suffered because of another driver’s negligence.

State law requires that auto accident complaints be filed within a specific amount of time regardless of the type of accident. Therefore, the same time limitations apply to a hit and run accident, a parking lot accident and truck accidents.

Auto accident complaints are generally filed in state court and allege that another person’s negligence caused your injury. The complaint must explain the facts of the case and why the facts will prove that the other person’s negligence caused your injuries. In order to file a negligence claim, your complaint must allege that:

  • The defendant owed you a duty of care
  • The defendant breached the duty of care by failing to act like a reasonable person would act;
  • The defendant’s breach of the duty of care caused your injuries and /or property damage that would not have happened but for the defendant’s breach of the duty of care; and
  • You are entitled to damages as a result of the above elements being satisfied.

Your complaint must also meet the technical requirements of state law, be signed and be properly served to the defendant.

Help from an Auto Accident Lawyer

The legal requirements of an auto accident complaint make it difficult to file the complaint without the help of an auto accident lawyer. An auto accident lawyer will make sure that your complaint contains all of the legally required information, is filed in the right jurisdiction, is filed within the required timelines, and is drafted to your legal advantage.

Lemon Law in Pennsylvania

Pennsylvania Lemon Law

Pennsylvania’s automobile lemon law is designed to protect you from being financially burdened by a dud vehicle. If you suspect you may have been sold a lemon, regardless of whether it was intentional or unintentional, make sure you understand what the law covers before threatening the seller or manufacturer with legal action.

Basically, the Pennsylvania lemon law allows manufacturers a number of attempts to repair a defective new vehicle before they need to either replace the vehicle or refund your purchase.

On this page you’ll find an overview of some of your rights and protections under the PA lemon law and the steps you may need to take if you end up buying a lemon.

Vehicles Covered in Pennsylvania

The Pennsylvania automobile lemon law covers most new vehicles purchased or leased―in- or out-of-state―and registered with the Pennsylvania Department of Transportation (PennDOT).

Motorcycles, motorhomes, and off-road vehicles are not protected by the Pennsylvania lemon law.

Lemon Law Protection

The law states that the manufacturer must correct any flaw, at no cost to you, that occurs under any of the following conditions:

  • Within 1 year of the vehicle ownership.
  • Before the vehicle’s odometer clicks out 12,000 miles.
  • While the express warranty is still valid.

By definition, the defect must be something so substantial that it either:

  • Significantly decreases the car’s resale value.
  • Makes the car unsafe to drive and likely to cause a serious injury or death.
  • Impacts the normal functions of the car.

Minor defects are generally not covered by the lemon law. Additionally, defects caused by abuse, misuse, neglect, or unauthorized modification are not covered by the lemon law.

Lemon Law Documentation

To assure that the Pennsylvania automobile lemon law works in your favor, begin maintaining detailed records the moment you start having problems with your car. These documents will serve as your star witnesses should you go to court. To prove you’ve been sold a lemon, have ready:

  • Sale or lease documents.
  • Maintenance records, including receipts for maintenance supplies.
  • Repair statements.
  • All documents pertaining to the flaw.

Filing a Lemon Law Claim in PA

If the defect in your car has not been rectified after a reasonable number of attempts to repair, or if your vehicle slumbers out of service for a total of 30 days or more, you may be eligible for a replacement vehicle of the same value or a full refund.

The vehicle manufacturer is able to deduct a portion of the vehicle’s value depending on how much you used the car before the defect put it out of service. Additionally, if the manufacturer cannot replace the exact model or year of your defective car, they will need to replace it with one of equal value.

To initiate compensation, you need to alert the manufacturer of your intentions and allow them to attempt to repair your vehicle. If you are met with indifference or are completely brushed off, the Pennsylvania automobile lemon law―under the backing of the state’s attorney general―gives you the green light to launch arbitration or a lawsuit.

Arbitration

If your vehicle is not repaired after a reasonable amount of attempts and time to repair, contact the manufacturer’s zone representative at the telephone number listed in the owner’s manual of your vehicle.

If the representative is unable to rectify the defect, you may request an arbitration through the manufacturer’s dispute settlement program. If the manufacturer does not offer an arbitration program there are other third party options.

The arbitration decision is binding on the manufacturer, but not on you. That means if you’re unsatisfied with the decision, you may proceed further with a lawsuit.

In the case that you’re entering arbitration or a lawsuit, an attorney with lemon law experience can work with you to ensure that you get the best possible outcome.

Hiring a PA Lemon Law Attorney

The idea of going against a major corporation, such as an automobile manufacturer, can be quite intimidating. That’s why obtaining the services of a lawyer may be beneficial to you. When you set out to find an attorney, be sure to look for someone who has experience with lemon law cases.

You’ll want to ask about his or her:

  • Case track record.
  • Lemon law experience.
  • Fee policy.

In addition, it’s also important to remember to trust your intuition. With tens of thousands of dollars on the line, you’ll want a lawyer you trust to successfully resolve your case.

Pennsylvania Lemon Law Assistance

If you have questions or concerns, call the Office of Attorney General’s Bureau of Consumer Protection at (800) 441-2555. The General Assembly of the Commonwealth of Pennsylvania provides details of the lemon law.

If you need legal advice, you should contact an attorney.

Effects of Technology on Business – How has technology changed the way we conduct business?

How has technology changed the way we conduct business?

Businesses have been at the forefront of technology for ages. Whatever can speed production will draw in more business. As computers emerged in the 20th century, they promised a new age of information technology. But in order to reap the benefits, businesses needed to adapt and change their infrastructure [source: McKenney ]. For example, American Airlines started using a computerized flight booking system, and Bank of America took on an automated check-processing system.

Obviously, now, most business is conducted over personal computers or communication devices. Computers offer companies a way to organize dense databases, personal schedules and various other forms of essential information.

As information travels faster and faster and more reliably, barriers of distance disappear, and businesses are realizing how easy it is to outsource jobs overseas. Outsourcing refers to the practice of hiring employees who work outside the company or remotely — and even halfway across the world. Companies can outsource duties such as computer programming and telephone customer service. They can even outsource fast-food restuarant service — don’t be surprised if you’re putting in your hamburger order with a fast-food employee working in a different country entirely. Outsourcing is a controversial practice, and many believe that U.S. companies who take part are hurting the job market in their own country. Nonetheless, from a business perspective, it seems like the wisest route, saving companies between 30 and 70 percent [source: Otterman ].

Another technology that’s starting to revolutionize business is actually not very new — it’s just cheaper these days. Radio frequency identification (RFID) technology is infiltrating and changing business significantly in a few ways. Microchips that store information (such as a number equivalent of a barcode and even an up-to-date history of the chip’s travels) can be attached to product, and this helps companies keep track of their inventory.

Some businesses have even begun to use RFID chip implants in humans to tighten security. An access control reader detects the chip’s signal and permits the employee access to the door. But many people are concerned about privacy issues if this were to become widespread practice.

Handheld devices like BlackBerries have become wildly popular for businesses because they let users check and send email from anywhere, and browse the Internet .

On the next page, we’ll take a deeper look at the Internet in particular and its affect on business.

    Check Ya Grammar Skillz

Grammarians aren’t as thrilled about the age of e-mail, texting and instant messaging as others. Because speed has taken precedence over formality, many people have picked up some bad grammar habits. One promotional study looked at 5,000 business correspondence samples and found that 85 percent had at least one grammatical or spelling error [source: Pirozzolo ].

Anyone can be a leader – inspiring others, helping others, making a positive difference to someone or something. Leadership is most effective and easiest when it is adaptable. Explore different theories of leadership – they each offer adaptable methods, styles, etc.

What’s the most powerful rule of negotiating.

    Have an alternative.

    Be able to walk away.

This simple principle is often ignored, particularly because as buyers or sellers we all tend to focus and fixate on a single option, which quickly creates a dependence on it, which produces pressure (including time/deadline) to agree a deal, which weakens our position, and strengthens the position of the other side.

Nudge theory helps us understand why we fixate on a single option, and why the apparent desirability of a single option increases.
