Effective Date and Application of Rules

Pub. L. 93–595, §1, Jan. 2, 1975, 88 Stat. 1926, provided: “That the following rules shall take effect on the one hundred and eightieth day [July 1, 1975] beginning after the date of the enactment of this Act [Jan. 2, 1975]. These rules apply to actions, cases, and proceedings brought after the rules take effect. These rules also apply to further procedure in actions, cases, and proceedings then pending, except to the extent that application of the rules would not be feasible, or would work injustice, in which event former evidentiary principles apply.”

The Federal Rules of Evidence were adopted by order of the Supreme Court on Nov. 20, 1972, transmitted to Congress by the Chief Justice on Feb. 5, 1973, and to have become effective on July 1, 1973. Pub. L. 93–12, Mar. 30, 1973, 87 Stat. 9, provided that the proposed rules “shall have no force or effect except to the extent, and with such amendments, as they may be expressly approved by Act of Congress”. Pub. L. 93–595, Jan. 2, 1975, 88 Stat. 1926, enacted the Federal Rules of Evidence proposed by the Supreme Court, with amendments made by Congress, to take effect on July 1, 1975.

Legal Nurse Consulting Theory Practice I

This course is the foundational course for the Legal Nurse Consulting program and provides a comprehensive learning program for the current principles and practices of Legal Nurse Consulting today. This course examines issues of health care and nursing law, as well as the judicial system. This course utilizes the most current and authoritative textbook in the specialty of legal nurse consulting and presents all facets of the practice. You receive comprehensive education in the professional practice of consulting, as well as appropriate health care and nursing law. Continuation of the study of legal nurse consulting continues in the other three track courses for this specialty. Requirement for this course is current state licensure/registration as a Registered Nurse.

Course Code: LN 400. Contact hours of education = 45. Course Cost: $250.00.

Legal Nurse Consulting Theory Practice II

This course is the second foundational course for the Legal Nurse Consulting continuing education program and provides for comprehensive learning of more of the current principles and practices and theories of Legal Nurse Consulting today. Students undertake an in depth study of the role, responsibilities, and practice options of a professional registered nurse practicing legal nurse consulting. Solid foundational principles of nursing law are examined as well as a model of research and practice for the legal nurse. This course provides a major emphasis on various types of cases that legal nurses consult on, including theory, practice and application for consulting.

Course Code: LN 420. Contact hours of continuing education = 45. Course Cost: $250.00.

Legal Nurse Consulting Theory Practice III

This third course continues in the study of practice and case analysis for legal nurse consulting. The focus is on the responsibilities of the legal nurse consulting related to case consulting, the role of the legal nurse in expert testimony, and the role of the legal nurse in trial and in mediation/arbitration. Legal issues of practice as well as ethics are examined. Students also study practice setting, building and marketing strategies. This course brings all of the knowledge, skill attainment, and theories together in preparation for the fourth case, which focuses on case analysis and report/consulting writing. Preparation for expert testimony is also examined.

Course Code: LN 430. Contact hours of continuing education = 45. Course Cost: $250.00.

Legal Nurse Consulting Process Application

This final course is pivotal for bringing everything together in the building of a solid knowledge and theory base in legal nurse consulting practice. Students study actual cases and legal nurse consulting reports and learn additional skills related to work product for attorney clients. Effective report writing methodologies are examined. This course culminates in the actual full analysis of cases from the legal nurse consulting viewpoint and work product. Students conduct a real case analysis with full applicability of learned materials from the entire continuing education program of study. This course also provides the knowledge necessary to undertake one more additional and optional Continuing education course for those seeking a CE activity in a preceptorship with an attorney, law firm or a practicing legal nurse consultant.   • To prepare registered nurses to enter the practice of Legal Nurse Consulting with sufficient knowledge for practice at a standard required by the employment market.
  • To prepare registered nurses to practice in a variety of practice settings as a legal nurse consultant including; medical and nursing malpractice, expert witness role, toxic torts, product liability, insurance industry, law firms, health care related organizations, and as an entrepreneurial legal nurse consultant.
  • To understand and practice legal nurse consulting with regards to high ethics and adherence to standards of practice
  • To prepare new legal nurse consultants to increase their body of knowledge related to the practice of legal nurse consulting for personal and career growth.
  • To prepare registered nurses and practicing legal nurse consultants to successfully achieve certification.
  • To prepare legal nurse consultants to develop their own marketing plans for career and business growth.
  • To provide legal nurse consultants with a quality continuing education experience for the practice of legal nurse consulting and for application for certification.

Additional Information:

  • Interested applicants must be a current, licensed registered nurse in the state or country of current practice.
  • All four courses are required to be successfully completed in order to be eligible for Certification status.
  • All courses are continuing education courses and are provided in online classrooms via our website. Upon enrollment a unique identification and password is provided for classroom access. The online classrooms provide full syllabi and course information, including the course exams and evaluations. Students must a achieve a minimum score of 70% on the course examination to pass the continuing education courses.
  • You may register for one course at a time. Once a student registers for the first course, they have a full two-year period of time to complete all four courses required. The total number of contact hours for the courses is 165 hours of continuing education.

10. Lawyers

Ahh, just what the world needs, more lawyers. Reactions like these aren t uncommon when it comes to the legal profession, but when you re in a bind, you ll be thankful to have a good lawyer by your side. Lawyers have to go through years of schooling, and read a stupid amount of text to do what they do, but they re usually paid well when they get hired. Oh, and they re considered the most attractive profession on Tinder, so there s that. More than half a million lawyers make up the workforce, which amounts to nearly as many doctors and surgeons. California and New York lead the way with nearly 150,000 practicing lawyers working in the two states alone, but those in Washington, DC, are the highest paid on average. 9. Airline Pilots, Co-Pilots and Flight Engineers

Want to have your office above the clouds, get free travel and make lots of money? Easy, become a pilot. Well, maybe easy isn t the best word to use. Becoming a pilot requires a bachelor s degree in an aviation-related discipline, a commercial pilot s license from the Federal Aviation Administration (FAA) and an Airline Transport Pilot (ATP) certificate. You ll also need several hundred hours of pilot-in-command experience, specialized training in specific tools and devices, as well as regular physical and mental testing. It s all pretty expensive and time-consuming, and it can take 10 years or longer before a newly minted pilot starts making serious cash flying the longer scheduled passenger flights. But that s not the end of it. Airline jobs, particularly for popular commercial airlines, are expected to be scarce in the coming years, so if you want to get a job, you might have to fly for low-cost regional airlines and nonscheduled aviation services, at least to start. There s not really an undisputed champ when it comes to the best school for aviation, but the Embry-Riddle Aeronautical University. which has campuses in Florida and Arizona, is a good school.

Whether you’ve received a payment to fix your roof or to replace your income while you recover from an accident, you’re likely to feel relieved that you had insurance and that it worked the way it’s supposed to. Before you spend that benefit, though, you might wonder if you ought to set aside some of the proceeds to pay income taxes on the money.

“Generally, if you’re paying premiums yourself, such as for homeowners insurance and auto insurance, then your insurance benefits are not a taxable event,” says Adam Sherman, CEO of Firstrust Financial Resources in Philadelphia. “Your benefits are reimbursement for expenses, rather than income.”

Still, there are times when an insurance payout or policy will attract the attention of the Internal Revenue Service or state tax authorities. Here’s a look at the various types of insurance, answering the question: Taxable or tax-free?

Homeowners insurance

Benefits: Generally not taxable. When you are reimbursed for a claim to repair your home or even replace it if it’s destroyed, such as in a fire, no tax is owed.

“If you’re repairing damage to your personal residence, then your benefits are not taxable,” says Gregory Burke, a certified public accountant with John Waddell Co. in Sacramento, Calif.

But he adds: “There may be an exception in the case of an insurance claim on an investment property, because the insurance proceeds could be considered a taxable gain if you don’t reinvest the money fast enough to repair or replace the property.”

Auto insurance

Benefits: Generally not taxable. Insurance money you receive after a car accident or when your car has been stolen is not reported as income, says Burke.

“If you are repairing or replacing your personal vehicle, then you don’t have to pay taxes on the insurance benefit,” he notes. “However, if you deduct part of the cost of your car as a business expense, the insurance benefit might be considered a gain. You are only taxed on the benefit if the insurance reimbursement is above the amount of your tax deduction for the use of your car.”

Life insurance

Death benefits: Sometimes taxable. “Death benefits on an individual’s life insurance policy are not considered taxable income,” says Drew Tignanelli, president of the Financial Consulate, a financial planning firm in Hunt Valley, Md. “However, depending on the amount of the life insurance policy, how it is owned and the state where the deceased person lived, you (the beneficiary) could have to pay estate taxes on a life insurance policy.”

Federal estate taxes must be paid on life insurance benefits above $5.25 million in 2013, but only if the policy was owned by the deceased individual, says Tignanelli.

“If a life insurance policy is owned by the beneficiaries, they won’t have to pay an estate tax,” he says.

The minimum benefit subject to state estate taxes varies. For example, in Maryland, life insurance benefits of more than $1 million are subject to the state’s estate tax.

Dividends and interest:

Sometimes taxable. Unlike term life insurance policies, many permanent life insurance products earn dividends or interest.

“Dividends are typically considered a return of the premiums you have paid and are not taxable unless you previously deducted the premiums from your taxes,” says Burke.

But interest that accrues on a cash value life insurance policy will be considered taxable income, and you should receive a Form 1099 showing the total interest earned each year, he says.

Many insurance companies offer policyholders the option of using their interest to buy additional insurance. In that case, the interest is not taxed, Tignanelli says.

Disability insurance

Benefits: Sometimes taxable. Whether disability insurance benefits are taxable depends on how you paid your premiums, says Sherman.

“If you pay your premiums with pretax income, then the benefits are considered taxable income,” he says. “If you pay the premiums with after-tax dollars, then the benefits are tax-free.”

Tignanelli says most disability insurance policies cover only 60 percent to 70 percent of your income if you become disabled, so he recommends purchasing your policy with after-tax income so you won’t have to worry about taxes if you have to receive benefits.

“It’s a lot easier to handle that drop in income if it’s tax-free,” he says.

Long-term care insurance

Benefits: Sometimes taxable. Sherman says long-term care insurance benefits are typically tax-free.

“However, some people can deduct a portion of their long-term care insurance premiums from their taxes,” says Sherman. “If you deducted some of your premiums, you may have to pay taxes on some of your benefits.”

Your benefits also could be taxed if they exceed your medical expenses.

“As long as you have a doctor attest to your need for care, some insurance policies will pay your benefits even if you are being cared for at home by a family member rather than incurring expenses in a nursing home,” says Tignanelli. “In that case, since you wouldn’t actually have reimbursable medical expenses, your benefits would be considered taxable income.”

Health insurance

Employee benefits: Sometimes taxable. Currently, health insurance is not taxed in most circumstances. But one exception is employer-sponsored health insurance for workers’ domestic partners, which is considered taxable income under federal law.

An employee must pay tax on what his or her partner’s coverage costs the company; some employers “gross up” an employee’s salary to cover that tax.

If a domestic partner qualifies as a dependent of the employee, then the health insurance coverage is tax-free, says Burke.

“In order for a domestic partner to be a dependent, the partners must reside in the same household and the other partner must provide over one-half of his or her support,” he says.
